These policies apply to everyone who serves papers for Swift Serve SoCal, a California limited liability company. Every process server working with us is an independent contractor and a registered California process server. They are published so clients, the people we serve and the people who work with us know the standards we hold ourselves to. They are general information and are not legal advice.
1. Accuracy and honesty
Every attempt log, field report and proof of service must describe exactly what happened, when and where. Never guess, round, back-date or "fill in" a description. If something is unknown, say so.
2. Zero tolerance for sewer service and false declarations
"Sewer service" — claiming papers were served when they were not — and any false statement in a proof of service are grounds for immediate removal, withholding of pay for the affected job, and referral to the court and authorities. A proof of service is signed under penalty of perjury; perjury is a crime under California Penal Code §118 (punishable under §126). Registered process servers can also lose their registration (Business and Professions Code §22350 et seq.). We cooperate fully with courts, counsel and law enforcement.
3. Mandatory photo or video proof
Every completed serve requires at least one photo or video uploaded to the portal (for example a Meta glasses clip or a photo of the property). Every attempt requires a photo of the property. Jobs without required proof are not approved and are not paid.
4. Signed proof of service
Each completed serve requires the contractor's signed field report (typed name, drawn signature and the declaration under penalty of perjury) and, when served, a signed proof of service on the official Judicial Council form (e.g. POS-010) prepared from those facts.
5. Lawful recording
Record only what the law allows. California Penal Code §632 prohibits recording a confidential communication without the consent of all parties. Do not record inside private spaces you are not lawfully in, do not record confidential conversations, and stop recording if asked where the law requires it. Recordings are evidence of service, not content: never post or share them.
6. Confidentiality of client and subject information
Names, addresses, case details, documents, photos and video are confidential. Use them only to complete the assignment, keep them on secured devices, never share them with anyone outside Swift Serve LLC, and never post them online. Do not leave the internal server worksheet with the subject.
7. Independent contractors (1099)
Process servers who work with Swift Serve LLC are independent contractors, not employees. They choose which jobs to accept, control how and when they perform the work, use their own vehicle and equipment, and may work for others. You are an independent contractor. Swift Serve LLC withholds $0 for taxes. You are responsible for your own federal and state income and self-employment taxes. You will receive Form 1099-NEC if your payments in a calendar year reach the IRS reporting threshold ($2,000 for payments made in 2026; $600 for payments made before 2026; adjusted for inflation after 2026).
8. Pay only for documented, completed work
Pay if served is the payout amount shown on the job, recorded when the job is assigned to you. A job is payable only when it is completed, the required photo/video proof and signed report are submitted, and the owner approves it. Payouts are recorded in batches with a date, method and reference. Paid jobs are locked; any correction is a separate, explained adjustment line visible in your pay log.
9. Payouts, wallet and withdrawals
Approved, unpaid earnings appear as your available balance in the Wallet. To get paid, request a payout of any amount up to your available balance by direct deposit to your bank account, or by Venmo, Cash App, Zelle or PayPal. The office sends it outside the portal, usually within 2 business days, and marks it paid with the date and a reference; a direct deposit is a bank transfer from Swift Serve LLC that usually posts 1-3 business days after it is sent. There is no fee from Swift Serve LLC. Swift Serve LLC stores your payout handles (Venmo, Cash App, Zelle, PayPal) and your bank name, routing number and the last 4 digits of your account (the full account number stays encrypted and is opened only by the owner to send a transfer, and each time is logged) and never asks for card numbers or CVV. Every payout is a ledger line in exact cents with its payment reference. Inactive accounts or accounts with incomplete onboarding cannot withdraw.
10. Client payments
Clients pay Swift Serve LLC directly by PayPal, Zelle, Cash App or Venmo; the office verifies every payment before marking it received. Contractors must never collect money, card numbers or payment details from clients or subjects.
11. Indemnification
Contractors are responsible for their own conduct. Each contractor agrees to indemnify Swift Serve LLC against claims caused by the contractor's negligence, misconduct, unlawful acts or false statements, as set out in the Independent Contractor Agreement.
12. Non-discrimination and professional conduct
Treat everyone — clients, subjects, household members and the public — with courtesy and respect. No discrimination or harassment of any kind. No threats, force, trespass, impersonation of law enforcement, or misrepresentation. Never enter a home or gated area without lawful access. Walk away from any unsafe situation and report it.
13. Data retention and privacy
Case records, attempt logs, reports and proof media are kept in private, access-controlled storage for as long as needed for the case and our legal obligations (generally at least 3 years after completion), then deleted. Bank account numbers are encrypted and never displayed in full. Contractors must delete local copies of photos, video and documents after uploading them and closing the job.
