These Terms of Service ("Terms") apply to all process serving and related services provided by Swift Serve LLC, a California limited liability company based in Rancho Cucamonga, California ("Swift Serve LLC," "we," "us," or "our"), which does business under the brand name Swift Serve SoCal. References to Swift Serve SoCal mean Swift Serve LLC. Service of process is performed by our registered California process servers. By requesting a quote, sending documents to be served, or paying for services, you ("Client," "you") agree to these Terms. If you do not agree, please do not use our services.
1. Scope of Services
Swift Serve LLC delivers ("serves") legal documents provided by the Client on the persons or entities the Client names, and prepares a proof of service or declaration describing what was done. Services may include service of summons and complaints, subpoenas, small claims papers, family law papers, restraining orders, landlord-tenant notices and unlawful detainer papers, and similar documents, together with due diligence attempts and rush or same-day service when available.
We serve addresses in the Inland Empire (the valley communities of San Bernardino and Riverside Counties) and Los Angeles County. High Desert areas and other locations outside this area are served only by prior written agreement.
We serve documents only. We do not draft, review, file, or interpret legal documents, and we do not decide which method of service the law requires in your case. See Section 12 and our Legal Disclaimer.
2. Quotes and Pricing
- Services generally range from $60 to $200 per job. Every job is quoted individually before work begins.
- Your price depends on factors including the area and location of the address, whether the person is being served at a residence or a business, road access (for example, unpaved or hard-to-reach roads), urgency (rush or same-day), and the number of addresses or attempts requested.
- A quote is based on the information you give us. If that information turns out to be wrong, incomplete, or changes (for example, the person has moved, the address does not exist, or the location is farther or harder to reach than described), the price may change. We will tell you and get your approval before doing additional paid work.
- Additional addresses, attempts beyond those quoted, stakeouts, or extended wait time may be quoted separately.
3. Payments
- Payment is due before or at the time service is attempted, unless we agree otherwise in writing. We may hold documents and not begin attempts until payment is received.
- How to pay. You can pay from your private customer link at /customer/ with PayPal, Zelle, Cash App or Venmo. Your price is shown before you pay.
- Person-to-person payments. You send the payment yourself from your own PayPal, Zelle (through your bank), Cash App or Venmo account, with your case number in the note, then press "I've sent payment" on your customer page. Your case shows payment pending verification until we confirm the money has arrived in our account; the job is scheduled once we confirm it. Send payments only to the account shown on your customer page, and never send card or bank numbers by text, email or memo.
- These payment apps are operated by third parties under their own terms and privacy policies. Swift Serve LLC never receives or stores your card number, security code (CVV) or bank-account number.
- No surcharge is added by us. Third-party apps may charge you their own fees.
- Fees pay for our time, travel, and effort in attempting service. Fees are earned when attempts are made, whether or not service is successful (see Sections 6 and 8).
- Court filing fees and other third-party costs are the Client's responsibility unless we agree otherwise in writing.
- Disputes. Please contact us first at 760‑961‑1813 so we can fix any problem. If you dispute a payment for services that were performed, we may provide your payment records and proof of attempts to the payment app or your bank.
4. Client Responsibilities
You agree to:
- Provide complete, accurate, and current information about the person or entity to be served, including full name, address(es), and any helpful details (description, photo, vehicle, work schedule, or best times to find them).
- Provide complete, correct, and properly prepared documents, with the number of copies needed for service.
- Tell us about any deadlines, hearing dates, or special instructions before we begin.
- Tell us promptly if the case settles, is dismissed, or service is no longer needed.
- Tell us about any known safety concerns at the service address (for example, dogs, weapons, or a history of violence).
- Use our services only for lawful purposes and not to harass, threaten, or locate anyone for an unlawful purpose.
You are solely responsible for the legal content, accuracy, and sufficiency of the documents, for choosing the correct method of service, and for meeting all court deadlines. Swift Serve LLC is not responsible for errors or omissions in documents prepared by you, your attorney, or anyone else.
5. Attempts and Due Diligence
- We make reasonable, good-faith attempts to serve at the address(es) you provide, at different times of day and on different days when appropriate.
- The number of attempts included will be stated in your quote. If no number is stated, we will make a reasonable number of attempts for the type of service requested.
- We keep notes of each attempt (date, time, location, and outcome) and can provide a report of attempts or a declaration of diligence on request.
- We will not trespass, break the law, use force, or misrepresent who we are to complete service. We may decline or stop attempts at any location we reasonably believe is unsafe.
6. No Guarantee of Successful Service
We cannot guarantee that any person or entity will be served, or that service will be completed by a specific date. Some people avoid service, have moved, or cannot be found at the address provided. We also cannot guarantee how a court will rule on the validity of service or on your case. Payment is for our services and attempts, not for a particular result.
7. Proof of Service and What You Receive
- What you receive: Every serve includes a signed proof of service, plus photo documentation — a photo or Meta glasses video of the service and/or a photo of the property.
- When service is completed, we prepare a proof of service or declaration, signed under penalty of perjury, that accurately describes the service. As required by California Business and Professions Code section 22360, a proof of service signed by a registered process server states the county of registration and the registration number.
- Photos and video are taken only to document service, are shared only with you and the court as needed, and are recorded in compliance with California law. In rare cases where photo or video is not safe or practical at the moment of service, we will tell you and document the service in writing and with a photo of the property where possible.
- Video may be recorded with camera-equipped smart glasses (such as Meta glasses) or another device. We record only from places where we are lawfully present, and we do not record confidential communications without the consent required by California law (including Penal Code section 632).
- Photos and video are supporting documentation. They do not replace the signed proof of service, and we cannot guarantee that a court will accept, consider, or rely on them. You agree to use them only for purposes related to the legal matter, and not to post them publicly or use them to harass anyone.
- If service cannot be completed, we can provide a written report or declaration of the attempts made.
- We will state only what actually happened. We will not sign any proof of service or declaration that is false or misleading.
- Unless we agree otherwise, the Client is responsible for filing the proof of service with the court.
8. Cancellations and Refunds
- You may cancel a job at any time by calling 760‑961‑1813 or telling us through the request form.
- If you cancel before any attempt has been made, we will refund your payment in full, less any third-party costs already incurred.
- Once an attempt has been made, fees for work already performed are non-refundable. We may refund part of the payment for work not yet performed.
- Rush or same-day fees are non-refundable once we have started the rush job.
- How refunds are paid. Refunds are sent by the same method you used to pay (PayPal, Zelle, Cash App or Venmo) or by check.
- No refund is owed because a person could not be served, avoided service, or was not at the address provided, or because of wrong or incomplete information supplied by the Client.
9. Confidentiality
We treat your documents and case information as confidential and use them only to perform the services you request, as described in our Privacy Policy. We may disclose information when required by law or court order, or as needed in a proof of service or declaration.
10. Limitation of Liability
To the fullest extent permitted by law:
- Swift Serve LLC's total liability for any claim related to our services is limited to the amount you paid us for the specific job giving rise to the claim.
- We are not liable for indirect, incidental, special, or consequential damages, including lost cases, missed deadlines, lost profits, or court rulings, including those caused by inaccurate information or documents provided by the Client, a person's avoidance of service, or events outside our reasonable control (such as weather, road closures, traffic, illness, or emergencies).
Nothing in these Terms limits any liability that cannot be limited under California law, including liability for fraud, willful injury, or violation of law (see California Civil Code section 1668).
11. Right to Refuse Service
We may decline any job, including jobs we believe are unsafe, unlawful, outside our service area, or intended to harass anyone.
12. Not a Law Firm; No Legal Advice
Swift Serve LLC is a process serving business. We are not a law firm, we are not attorneys, and we do not give legal advice. Nothing we say or provide, including on our website, flyers, or Google Business Profile, is legal advice. If you need legal advice, please consult a licensed California attorney or your court's self-help center.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California. Any dispute arising out of these Terms or our services will be resolved in the state courts located in San Bernardino County, California, unless the law requires otherwise. Before filing any claim, both parties agree to first try in good faith to resolve the dispute informally by contacting each other.
14. Changes to These Terms
We may update these Terms from time to time. The version posted on our website on the date you request service applies to that job. The "Last updated" date at the top of this page shows when these Terms were last changed.
